temp-post-image

Due to the ongoing public health concerns associated with COVID-19, and the continued need to
enforce social distancing requirements, Section 341 meetings will be conducted telephonically beginning April 16, 2020, for as long as the need to engage in social distancing measures continue.

The Clerk’s Office has begun issuing Notices of Chapter 7 Bankruptcy Case indicating the Section
341 meetings will be held telephonically. The Notices provide all parties with their assigned Trustee's
dedicated teleconference number and a participant pass code.

The following is guidance on the procedures to be followed in connection with telephonic Section 341 meetings for Trustees to be followed for the 341 telephonic hearing.

Each debtor or couple will be assigned their own ten-minute meeting slot and meetings will commence promptly
at the scheduled meeting time. In order to reduce the number of participants on the line for each
Section 341 meeting, and thereby improve the quality of the record, it is recommended that
participants dial-in to the teleconference line no sooner than five (5) minutes prior to the scheduled
meeting time.

Prior to the Section 341 meeting, Debtors must provide photo identification and acceptable proof
of social security number to the Trustee. To facilitate verification of debtors’ identity and social
security number. Most Trustee's are requesting debtors to submit a high quality color photograph of
the debtors’ original photo identification and proof of social security number. Information on how to provide the documents will be provided to pro se debtor's directly or to debtor's attorney.

Cases requiring interpreters mustnotify the Trustee prior to the 341 Meeting of any cases which
need interpreters. These cases will be held using the same interpretation service as before.

Debtors and their attorneys may be in the same location or they may participate separately by
calling in from different locations. However, the debtor’s attorney will need to have video
capability with their clients if they are calling in from separate locations.

In order to ensure the quality of the record, as well as increase the efficiency and improve the
overall meeting experience, all parties are reminded of the following guidelines for telephonic
meetings:

  • When joining the meeting, do not announce your presence, especially when the Trustee is conducting another meeting. Counsel should instruct his or her clients of this requirement.
  • The use of speakerphones is prohibited, and the use of cells phones is discouraged.
  • Do not conduct calls in public places, or while driving or in a moving car. Background noises (particularly wind) are very distracting.
  • Put your phone on Mute when not speaking.
  • Make an extra effort to speak slowly, clearly, and calmly.
  • Announce your name as much as practical.
  • Consider pausing a moment before speaking as delays are common.
  • Wait until you are called upon by the Trustee before speaking and do not talk over or interrupt another speaker.
  • Any telephonic appearances by represented debtors without their counsel present on the call will result in a continuance.
  • If you miss your meeting time, do not call in late. Your meeting will be continued to a later date and time.
